2. Collection of Personal Information
You can browse public areas of our Website without revealing any information by which someone could identify you as a specific individual. However, if you wish to register for events, apply for membership, or log into the NEBA Member Portal, you will be required to provide certain Personal Information.

Contact Information: Full name, business name, email address, phone number, physical address.
Account Credentials: Username, unique user ID, portal password.
Business & Professional Details: Business directory details, board/director status, operational roles, logo assets.
Payment Details: Credit card details or billing information (processed securely via third-party processors).
User Submissions: Feedback, community posts, committee files, or event registration data.
3. Use and Processing of Collected Information
NEBA acts as a data controller and data processor depending on the context of the information provided. Any information we collect from you may be used for the following purposes:
Create and manage user and member portal accounts.
Process membership applications, renewals, and event registrations.
Deliver portal access, leadership updates, community files, and member benefits.
Send administrative updates, security alerts, and system notices.
Send marketing, newsletter, and promotional communications (with opt-out options).
Respond to inquiries and provide member support.
Enforce our Terms and Conditions and protect against malicious activity.
Run and operate our organizational website and membership portal.
4. Payment Processing
For Services requiring payment (such as dues or luncheon tickets), you may need to provide credit card or financial account details. We utilize PCI-compliant third-party payment processors to handle all transactions securely. Sensitive and private data exchanges occur over SSL-encrypted communication channels. We share financial data with payment processors solely to the extent necessary to process payments, handle refunds, or address billing queries.
5. Managing Information
You have the ability to access, update, or delete certain Personal Information within your portal account profile. When you request the deletion of Personal Information, we may retain a copy of unrevised records in our archives for the duration necessary to comply with legal, financial, and auditing obligations.
6. Disclosure of Information
We will not sell, rent, or trade your Personal Information. We share your data only with trusted contracted service providers who assist us in operating our Services (such as website hosting providers, portal platform providers, payment processors, and email communication tools). These third parties are bound by strict confidentiality requirements and are authorized to use your Personal Information solely to perform services on our behalf.
We may also disclose Personal Information if required by law, such as to comply with a subpoena or legal process, or when we believe in good faith that disclosure is necessary to protect our rights, safety, or the community.
7. Retention of Information
We retain your Personal Information for as long as your portal account remains active, as needed to fulfill membership services, or as required to comply with our legal and tax obligations. Once retention requirements expire, your Personal Information will be securely deleted.
8. Transfer of Information
Our digital infrastructure and servers are primarily hosted within the United States. If you are accessing the Services from outside the United States, please be aware that your information will be transferred to, stored, and processed in the U.S., where our administrative operations are located.
9. Region-Specific Notices & US Privacy Rights

Request access to the specific categories of personal data we hold about you.
Request correction of inaccurate personal data.
Request deletion of your personal data.
Opt out of targeted advertising or promotional distributions.
Receive non-discriminatory service regardless of whether you exercise your privacy rights.
10. How to Exercise Your Rights
To exercise your privacy rights regarding your data, please submit a request by contacting us at [email protected] or [email protected]. We may require you to verify your identity before processing your request to ensure data security.
11. Cookies & Tracking Technologies
Our Services use “cookies” to personalize your online experience, store portal login sessions, and monitor website navigation. You have the ability to accept or decline cookies through your browser settings, though declining cookies may limit full functionality of the member portal.
12. Data Analytics
We may use privacy-compliant analytics tools to gather aggregated data regarding user traffic and activity on nebaelpaso.org. This statistical information is non-identifying and is used strictly to improve website performance and member experience.
13. Privacy of Children
NEBA does not knowingly collect or solicit Personal Information from children under the age of 18. If you believe a minor has submitted personal data to us, please contact us immediately for deletion.
14. Do Not Sell My Personal Information
NEBA does not sell, rent, or trade member or user personal data to third parties for monetary or valuable consideration.
15. Do Not Track Signals
Some web browsers feature "Do Not Track" (DNT) settings. Because uniform industry standards for DNT signals do not currently exist, our digital platforms do not currently alter operations upon receiving DNT browser signals, though we limit all data collection to essential organizational functions.
16. Advertisements & Directory Listings
NEBA may display public directory listings or highlight member sponsors. Any contact or arrangement made between users and third-party businesses listed in the NEBA directory is conducted independently between those parties.
17. Email Marketing & CAN-SPAM Compliance
We offer electronic newsletters and portal updates. All automated promotional emails sent by NEBA include an intuitive Unsubscribe link at the bottom of the message. Members will continue to receive essential transactional messages regarding portal security or membership status.
18. Push Notifications & SMS Communications
If you opt in to receive text messages or portal push notifications from NEBA, we use secure routing providers to transmit these alerts. You may opt out of SMS communications at any time by replying STOP to any text message received from us.
19. Links to Other Resources
The Services contain links to third-party resources (such as member websites or municipal resources). NEBA is not responsible for the privacy practices or content of external websites. We encourage you to review the privacy statements of any linked site you visit.
20. Information Security
We secure the information you provide on controlled computer servers protected from unauthorized access, use, or disclosure. We maintain appropriate administrative, technical, and physical safeguards. However, no data transmission over the Internet or wireless networks can be guaranteed 100% secure.
21. Data Breach Notification
In the event that NEBA becomes aware of a security breach compromising portal or user data, we will take immediate action to investigate, contain the issue, notify law enforcement where appropriate, and send email notifications to affected users in compliance with Texas data breach disclosure laws.
22. Changes and Amendments
We reserve the right to modify this Policy at any time. When updates occur, we will update the "last modified" date at the bottom of this document. Continued use of the portal or website following any policy updates constitutes acceptance of the modified terms.
